Since the landlord has a duty to mitigate, the $6,800 could be considered an illegal penalty and not a liquidated damages provision.

It would cost the LL more than 6800 to force payment of the 6800.

The contract is clear, but am I missing something that would allow the tenant to break the lease without paying the early termination fee? I don't think so, but this is not my practice area and it is a question from a friend.

Tenant signed a lease for 12 months and paid an extra half-months rent to begin to move things in early. Lease starts May 1st. Lease has a clause that he will pay $6800 if he stays less than 12 months. He has not moved in yet.

There is now an apartment in his current building that became available, and he really wants to stay there. Is there anything in Washington (Kirkland, specifically) that would allow him to terminate this lease? Any practical solutions from those of you who practice in this area regularly?
