[WSBARP] Sharing RE Commission

I understand the law here on both the RE Broker side and the RPC side.

All this being said, what about various forms of “thank you” gifts?

For example, a RE broker sending a Starbucks card (bottle of wine, etc..) to someone (say, an attorney) who referred them a client? Assume the referral is made without expectation of anything in return.

It is also a violation of the RPC’s. If a realtor wants to give the client a discounted rate for their commission because the client’s attorney notified them of a property to be listed, that would probably be ok. But there can’t be a kick back to an attorney.

Brokers can only share commissions with other licensed brokers, including out of state brokers.

I just received a flyer as maybe some of you did from a realtor in Bellevue stating that if we have a estate sale of real property and list with him and it sells he will share up to 20% of his commission with the attorney who can then pass it it on to client or keep it as referral fee. The attorney would obviously have to advise the client of this arrangement but can the realtor share commissions with a non realtor attorney?
