[WSBARP] Offer of Judgment in Boundary Line Dispute

Colleagues,

I have a case involving a boundary line dispute where the opposing party (and their counsel) fail to see reason. Although my client is willing to adjust the boundary line to the location requested, the opposing party continues to demand damages for claims we believe have no merit, driving up costs and fees that will never be recovered (for either side). Even worse, I do not believe opposing counsel is properly counseling his clients (as demonstrated by declarations submitted to the court on various motions). I fear my client will come out of pocket tens of thousands of dollars to defend the frivolous claims and am looking for ways to “stop the bleeding.” Has anyone submitted an offer of judgment in a case involving a boundary line dispute? If I were to submit an offer of judgment, would I need to engage a surveyor to prepare new legal descriptions, etc. before submitting the offer of judgment? I would appreciate any practical advice or ideas my colleagues may have to offer.

Thank you,
