[WSBARP] Eviction by alleging DV

H &W living in W's home. H's adult daughter and her husband come to stay in bsmt on temp basis but this lasts several months. W alleges DV and so H and daughter removed until Protection Order full hearing. If OP gets denied as to daughter, is W subject to fines, atty fees for what is an eviction without notice to daughter? Thanks
