Hi Bryce,

I assume you are talking about a homeowners association versus a condominium association. Unless the association opted in to be governed by RCW 64.90, then an amendment to the covenants would require 100% owner approval absent a covenant allowing an amendment with less than 100% approval. Even if there was such a covenant, 100% approval still might be required under the Washington Supreme Court's test set forth in Chiwawa.

In a development has an older set of protective covenants regulating use of property but it has no amendment provisions does that mean that 100% of lot owners  must approve. Under the provisions of RCW64.90. for communities established after July 1 2018 67% is all that is needed unless declaration specifies more up to 90%..  Id appreciate your input.
