[WSBARP] Judgment Establishing Boundary by Recorded Survey.

Roger,

Before the case started, I suggested a boundary line agreement. Their
response was to sue. The court granted my motion for SJ establishing the
boundary under both adverse possession that involved an old fence, that is
not straight, and by a boundary survey we had done. That survey cost just
over $4800.00. The court declined to award the survey costs. However, to
make the boundary issue easy the parties agreed to enter an order saying the
boundary line is as set forth on the survey. I hope that is the answer you
were looking for.

What was the total cost of getting the bla done that way?

Parties to a boundary dispute want to settle by entry of a court order
saying the boundary between their respective properties is as set forth in a
recorded survey. One party insists that, in the Judgment Summary, both
parties be listed as both judgment debtors and creditors. Have any of you,
in settling litigated boundary issues, used that kind of language in the
order? I don't see why the order just can't refer to the two parcels and
then say the recorded survey sets forth the correct boundary.
