[WSBARP] Rights of Purchaser to evict

Bryce -

This is an unknown I deal with relatively regularly. This argument has
not been debated in front of the Commissioners I have been in front of.
However, at a minimum I think it would require that the seller assigned the
right to the buyer.

However, it's not a far-fetched concern that some Commissioners could say
"well, clearly the previous owner could sell the Property with the tenant
in it - so unless the new buyer needs to sell or personally occupy, they
can't evict." So I think the answer to your question is going to depend a
lot on the location of the property and whether or not the opposing party
makes that argument.

Maybe others have had the specific question addressed in front of a
Commissioner (not that you can count on different Commissioners or
jurisdictions agreeing).
