I don’t think RCW 7.28.090 draws a distinction between a governmental and a proprietary capacity. And if you think about it, drawing a distinction does not make a lot of sense. Selling commodities such as water or electricity is a proprietary function. Allowing private citizens to adversely possess against either infrastructure or against natural areas surrounding a reservoir and intended to prevent contamination by pollutants would be disastrous.
Scott.

It is my understanding that if a governmental entity owns property in a proprietary capacity, you can adversely possess. A good example would be if a county was running a land fill.
Also, keep in mind that assuming the FDIC got it through some foreclosure process, if the ten years expired prior to that, there is no issue, since title by adverse possession vests at that time. It is
not like other boundary theories where vesting occurs when the court decrees it.

So the question of "if the government owns the property in its ministerial capacity" was because if it didn't then adverse possession is available, correct? Mike

Randy: I think the US District Court for the jurisdiction where the property is located is appropriate. Are you sure you cannot sue the FDIC in state court in the county where the property is? The FDIC as a governmental agency, would be holding the property in its ministerial capacity? Also, if they are an agency of the federal government, immunity to adverse possession may be an issue, unless the 10 years ran before the FDIC acquired title.

Subject: [WSBARP] Adverse Possession case against FDIC
Listmates
A lawsuit for adverse possession needs to be filed against FDIC that owns property.
I assume that needs to be filed in Federal Court. Would that be the district where the property is located or are there other jurisdictional or venue provisions that apply for a suit involving FDIC?
I?d appreciate any insight you have.
