Actually, you don't have to file at all.  Often times showing you are serious by serving folks with a well drafted summons and complaint will work; and if they demand you file it also, you are supposed to do so within the fourteen days; but there is no real pain incurred, usually, if you just wait to see what else transpires.

I have done that too, just to get a LAWYER involved, then it is easy to get the bank to sign off its interest.  PS-You can save some money by NOT filing with the Court. Serve the Complaint and Summons first. You don't have to file until 14 days after a written demand. It allows easier termination too.
