[WSBARP] No power of attorney

There is no power of attorney that can be granted after the principal is not competent. Sadly, that couple did not anticipate this possibility and prepare for it with a durable POA.

And you on this listserve: I'll bet there is at least one lawyer that has not properly done a POA with durable provisions, just in case. Do it!

Subject: [WSBARP] No power of attorney

Elder PC lives in Washington but snowbirds in Arizona where she is now in a hospital.  Her physician states that she is not competent and has dementia.  She has a competent husband, but no written power of attorney documents. Is there a statute that allows the husband to act as her power of attorney and make decisions both medically and financially or will she need him appointed as her guardian? I guess she could sign a POA in a moment of lucidity.
