Neither a title or escrow co was involved in the refi when first mortgage paid off and it was a Wash mutual refi so no records of payment and my client cant find her settlement statement from the refi.

Do the processes of 61.24.110 not work for your facts?  Or were those added remedies that haven't really worked out well?  I haven't heard much about the issue in the 7 years it's been in effect.
