[WSBARP] mineral rights question

All,

PC has a development agreement in place for a large parcel of vacant, undeveloped land. Commercial and subdivisions nearby. A number of years ago the mineral rights were sold to a third party known in the area to aggressively pursue mineral rights. PC wants to know that, when a binding site plan in place, can PC move dirt between lots and potentially remove dirt without incurring a legal obligations to the mineral rights holder? Any experience/thoughts on issues similar to this would be greatly appreciated.
