[WSBARP] Tefra Lien

I'd appreciate the lists collective wisdom in a situation where my client needed financing to purchase a house and her roommate who was working at the time agreed to be a cosigner and roommate's name went on title along with client.. Property  was subsequently refinanced by my client and roommate still stayed on the deed and note and D of T.. !2 plus years have gone by and my client has made all the principal, interest and real estate taxes as well as repairs on the property and roommate pd rent and this is verified by client tax returns.A year or so ago roommate went into nursing home and is receiving state aid.  This property was not listed in the application for benefits. The state has now filed a TEFRA lien against the property for benefits paid and to be paid in the future. I advised the state that ex roommate had no equitable interest in the property and they we were going to file a QC deed releasing her interest and state responded if she was on title she had a interest and if roommate QCed it back they would consider suspending her benefits. Has anyone dealt with this situation  and how do we get lien removed so my client can refinance. It is clear that ex roommate had no equitable interest and she will so verify. Thanks for you input.
