Note that the Leeches won the case but lost their request for attorney fees on appeal.  Evidently, this case also holds for the proposition that “money does not grow on trees.”

Now published opinion! This made my Monday afternoon far more entertaining.

"The Boyles brought a nuisance action against their neighbors, the Leeches, for staining caused by debris from a tree on the latter's property. The trial court granted the Leeches' motion for summary judgment, ruling as a matter of law that the Boyles did not establish actionable nuisance. We affirm."
