Amen to volunteers who wear the white hats. And thank you, Howard, for your
volunteer efforts (and thanks also to you, Paul, and others who volunteer).
Our profession honors the work that you do.

Paul,

I have attached the Order for Limited Dissemination that I use. I tried to
keep it on one page to save trees. I have no pride of authorship so you can
look at the statute attached and make whatever changes you deem necessary.
Quite a few of the landlord lawyers are not acquainted with the statute and
so far I have not had any objections. I let the landlord lawyer present the
order along with whatever other orders he is seeking. No judge has refused
to sign the order. I have not heard from any of the tenants saying their
eviction has shown up on a screening. Spokane is a small town. 2nd largest
in the state, but still a small town atmosphere and often there is good will
between the landlord and the tenant, especially in hardship cases. You may
find the same in Oak Harbor.

As for the dark side, it is the volunteers that wear the white hats. We have
a few landlord lawyers in Spokane who will help me on a large docket.

Thanks for volunteering,

Howard Herman

Mr. Herman, would you please post your form of the "Limited Screening
Order"? I sometimes cross over to the dark side of the force and volunteer
to do UD defense for the local bar.

Kary,

The court has the authority to enter a "Limited Screening Order" which
prevents screeners from reporting the eviction to future landlords. I keep
several copies of the Order in my brief case and find that many times the
landlord will not oppose the Order.

Isn't just the filing of an UD the kiss of death for finding a new rental?
I remember that one case where the tenant won because the landlord had no
grounds to evict, and even that made it difficult for them to rent
elsewhere.

Howard, I do have one request when you represent pro bono tenants: please
screen them so as not to represent a tenant who purposely goes from landlord
to landlord and fails to pay rent awaiting the landlord to eventually evict
them and then gets a pro bono lawyer to locate a technicality that sends the
landlord back to court multiple times, plus expenses to the Sheriff, and
costs the landlord (who may be a working class guy with one rental unit)
thousands of dollars. Then the tenant leaves the place a complete mess.
