[WSBARP] Withdrawal from probate - question

I just did this where I substituted in for another attorney on a probate during the claim period. I sent the Notice of Substitution to everyone who already received notice, and the withdrawing attorney will cooperate by sending me any claims he may receive from creditors.

The statute does not require published notice for a change in attorneys, only a change in PR’s. I would send your Notice of Withdrawal to the heirs, beneficiaries, and to all creditors who received actual notice, and provide the new address for the PR so claims, objections, etc, can be served on the PR if he/she is acting pro se. I would also tell the PR if you do receive claims from a creditor you will forward them on. I think that is the best you can do, without starting the claim period over again.

Subject: [WSBARP] Withdrawal from probate - question

PR client difficult. I gave client the option of working it out, or discharging me. Just received letter from client saying “I discharge you from representing me in the Estate of XYZ.”

I am preparing Notice of Withdrawal, will file with court, mail to heirs, file Declaration of Mailing.

How to handle Creditors Notice, which was only published 6 weeks ago? Does client have to republish, I would think. What if he doesn’t want to - is this on me?

Any other words of advice?
Regards,
