Paul, Well, I confess that I am now more confused. I had been working off of
the latest version I had, but checked the actual statute as codified, and,
well, you can read it for yourself. My fault; for many days the legislative
service that allowed access to bill versions was down and I just forgot to
go back and recheck:

64.001.117. Applicability to preexisting common interest communities
[Tentative classification and name line supplied by publisher]

(1) Except for a nonresidential common interest community described in
<https://1.next.westlaw.com/Link/Document/FullText?findType=L&pubNum=1000259
&cite=WAST64.001.121&originatingDoc=N7F8C03F063D011E891EC94A25D1B913A&refTyp

&cite=WAST64.001.326&originatingDoc=N7F8C03F063D011E891EC94A25D1B913A&refTyp
e=LQ&originationContext=document&transitionType=DocumentItem&contextData=(sc
.Category)> 64.001.326 apply, and any inconsistent provisions of chapter
59.18, 64.32, 64.34, or 64.38 RCW do not apply, to a common interest
community created in this state before the effective date of this section.

(2) Except to the extent provided in this subsection, the sections listed in
subsection (1) of this section apply only to events and circumstances
occurring after the effective date of this section and do not invalidate
existing provisions of the governing documents of those common interest
communities. To protect the public interest,
<https://1.next.westlaw.com/Link/Document/FullText?findType=L&pubNum=1000259
&cite=WAST64.001.120&originatingDoc=N7F8C03F063D011E891EC94A25D1B913A&refTyp
e=LQ&originationContext=document&transitionType=DocumentItem&contextData=(sc
.Category)> RCW 64.001.120 and
<https://1.next.westlaw.com/Link/Document/FullText?findType=L&pubNum=1000259
&cite=WAST64.001.326&originatingDoc=N7F8C03F063D011E891EC94A25D1B913A&refTyp
e=LQ&originationContext=document&transitionType=DocumentItem&contextData=(sc
.Category)> 64.001.326 supersede existing provisions of the governing
documents of all plat communities and miscellaneous communities previously
subject to chapter 64.38 RCW.

Then there is,

(1) Except as provided otherwise in this section, this chapter applies to
all common interest communities created within this state after the
effective date of this section.

 Chapters 59.18, 64.32, 64.34, and 64.38 RCW do not apply to common interest
communities created after the effective date of this section.

RCW 64.001.116

Nice. But the only thing I can say is that the Act does not apply tp
pre-existing CICs; and .326 either applies (64.001.117) or doesn't apply
(64.001.116).

By the way, there was some misnumbering between .325 and .326 in the version
I thought passed.
