[WSBARP] modification of decree re: real property

Couple divorced year and a half ago. Took house as tenants in common. 
Now he wants to buy her out.  Would an Agreed Modification of Decree 
signed by a commissioner work to avoid excise tax?  Any experiences out 
there?
