Jim,
I drafted the original bill sponsored by Senator King to remove the local opt out and testified in both the House and Senate regarding the impact to business owners. The "December 31, 2017" language was a political compromise requested by the Association of Washington Cities.  I have several cases involving this process currently as the provisions of RCW 8.26.180 apply regardless.  Previously there was no limitation and from this point forward all takings cases will have to comply with the relocation rules.

Has anyone dealt with, or Is knowledgeable about, the  recent amendment to the above referenced statute which states:

(4) The governing body of any local public agency may elect not to comply with the provisions of RCW 8.26.035 through 8.26.115 in connection with a program or project not receiving federal financial assistance initiated on or before December 31, 2017.

I'm being told by opposing counsel that it has the effect of completely nullifying Chapter 8.26 RCW when invoked in a condemnation proceeding.  Thanks in advance for any feedback.
