[WSBARP] HOA Declarations

State that construction of the foundation work on the home must commence within 3 years form the lots purchase and all construction and landscaping completed within 1 ½ years after residence construction began.  Violations trigger a $200 per day fine (unless waived). HOA may extend these dates by written agreement with the owner.  Client bought in august 2015, had trouble getting a construction loan, had to move the pad because of wetlands, are delayed in getting construction people because of the building boom and have not yet started any construction.   HOA is giving client until tomorrow to sign an Agreement to give them another year to commence construction.  Are there any legal pronouncements in this area?
