I don't think so, if a legal adoption into a new family. Adoption severs heirship to natural family and creates heirship to adopted family. See RCW 11.04.085<http://app.leg.wa.gov/RCW/default.aspx?cite=11.04.085> and RCW 26.33.260<http://app.leg.wa.gov/RCW/default.aspx?cite=26.33&full=true#26.33.260>.

Sincerely,

Eric

Although I send many thanks to Rob and Judy and others who suggested TEDRA or family settlement agreement, the problem is two beneficiaries who are not family and do not feel the love…

So the question remains, is there a legally defensible definition of “nephew” that will get us there???
