[WSBARP] Residential Landlord's Fee against Domestic Partners not on the Lease

Listmates- I have heard of a case where a landlord selectively chooses
certain tenants and charges extra fees to their domestic partners who have
not been officially added to the lease agreements.  

 

Having such co-residents not on the lease appears to violate a well-prepared
lease agreement, but what gives the landlord the right to determine a
specific amount of the fee in absence of explicit contractual terms
proscribing it?  Also, what claim can a tenant potentially have against the
landlord that does not charge such fee to most tenants in similar situations
but does so only to a few ones?
