I have a client who is interested in buying a property at auction brought by a city for delinquent sewer charges.

DSHS has a lien on the property, but DSHS is a named defendant in the suit by the city and language in the city’s suit and judgment says that it asserts primary position over all other liens.

The DSHS lien was filed on 1/24/17 and the city lien was filed on 2/28/28, so the DSHS is first in time, which is a basis for priority, right??

 

Any insights will be greatly appreciated…
