[WSBARP] RCW 76.09 forest land

I have a client who purchased land from the bank [assumable foreclosed upon, not sure yet if it was a judicial or non judicial]. At any rate, the property was previously logged and the DNR contract specifies that the seller must notify the buyer  and both must sign a NOTICE OF CONTIUING FOREST LAND OBLIGATION;  and then file with DNR office. The contract specifies that if seller fails to do so, that they are responsible for all of buyers fees, costs associated with replanting and/or enforcing.

It the property has foreclosed upon, the previous owner is off the hook, correct?  What about the bank?  I am assuming that the agreement was on title and she had constructive notice, but not sure of that yet either.

Any thoughts ?
