Scott,

       On your easement question, I do not recall any specific case addressing that issue, but there is a case or two that hold a tenant can establish prescriptive rights for the owner. In obtaining prescriptive rights, it is the acts related to the asserted dominant estate that control. In other words, were the people acting as guests of the dominant estate and were they acting in conjunction with their use of that property? I would look at the tenant cases and assess the rational, which should be applicable, I would think, to guests.

In defending against a claim of a prescriptive easement, I have come across
an issue I had not considered before. Seems that claimant is basing her
claim on the use of the claimed easement by claimant's family members - in
particular, the claimant's adult children, grandchildren, and the
grandchildren's spouses. This is not a situation of tacking, but rather
use of a claimed easement imputed to the claimant. None of the individual
claimant's have used the claimed easement often enough to satisfy the
requirement of continuity; one grandchild uses the claimed easement one
year, and another grandchild uses the claimed easement another year, and so
on. To me, the problem is that elements of a prescriptive easement require
that a particular person make use of an owner's land for the necessary
period, or that the successive use by two or more persons who have a
particular relationship (typically, successors in interest) be tacked
together to meet the relevant statute of limitations. And so a group of
people with a tenuous connection would not meet that test. Then I
remember, it is possible for the public to establish a public ROW by
prescription. So I remain confused. Any thoughts?

Mark, thanks. The issue to me is whether Washington's deed of trust act is
sufficiently different from Nevada's to lead to a different conclusion. The
precise point is not where the Agency, FHFA, as agent for FNMA and FHLMC, is
prior when there is record notice; the issue I have is, when there is no
record notice, how is anyone supposed to know that there is a prior interest
(prior although later-filed or not filed at all by virtue of federal
preemption)? Or whom to name and serve? This decision leaves a very large
mess. No foreclosure lawsuit is safe. Is there a clearing house for finding
out whether a note and/or deed of trust are in the hands of one of these?

An FYI that on Friday, per the attached, the Ninth Circuit decided against
condo associations having superpriority liens and in favor of the FHFA as
holder of FNMA and FHLMC loans. It basically held that as the Nevada
superpriority law conflicted with the FHFA statute, the statute preempted
it. 



This decision, while, as it was in line with earlier Nevada DC decisions,
was not unexpected, will impact association disputes on FNMA and FHLMC
loans.
