RE:       Condemnation Lawyer Referral
            East King County City/Property


1.      I need ASAP a referral to a knowledgeable and experienced condemnation lawyer.

2.      Self-referrals welcome – almost preferred to expedite action.

3.      Purpose -- to consult with property owner (developer), architect, surveyor and me regarding proposed “taking”.

4.      City (condemning authority) – East King County city.

5.      Property – undeveloped; adjacent to existing major public roadway.

6.      Status of Property Development – undeveloped; currently an analysis is being made of allowable commercial development under existing zoning, building and related codes.

7.      Nature of “Taking”

a.      By fee and easement, a strip of the property adjacent to the existing public roadway.

b.      Purpose of “taking” – completion of long-standing roadway improvements.

c.       Other properties (adjacent to roadway and now developed) will also be subject to the same “taking”.

8.      Issue – “Damages”

a.      The square foot area of property, setback from property boundary, etc. -- can impact size of building structure, parking requirements, etc.

b.      The development team is now analyzing whether the proposed “taking” will have any material negative impact on what would have been allowed without the taking.

c.       Issue – would any such negative impact constitute “damages” for which the property owner would be entitled to compensation?
