Bryce:
These safe harbor trusts are all intervivos trusts. I haven't seen one that is a testamentary trust. Essentially, there are your classic income only irrevocable trust often with some different language, usually due to a home being placed in it. However, the initial transfer is still a disqualifying transfer for Medicaid purposes.

Subject: [WSBARP] Safe Harbor Trusts

Over the last several months have had several clients inquire about "safe harbor trusts' which can be set up by will or by inter vivos trust so that assets in the trust are not considered as assets of the trust beneficiary applicant for medicaid nursing home care benefits. These are different then "special needs trusts". There is also an atty who has a talk show on KOMO on Saturday afternoon who advocates these trusts. Do any of you have familiarity with this type of trust? Thank you
