[WSBARP] Tenant in HOA-Dangerous Dog ?

List Mates:

Client (Tenant) has been renting a townhouse for 3 ½ years. Clients never been complained against. Client owns a Rottweiler. There are no incidents of bad conduct with this dog, no police complaints, no restraining orders filed or dog deemed by court of law that the dog is a dangerous animal.

Client has received some threats via (note) posted on clients door from an undisclosed source that the dog is barking inside her house and that fines will be levied against client.

Client than receives a letter yesterday from property management co. for HOA to remove the dangerous dog from the house within 30 days or the association will remove the dog. The letter also states that the dog is declared a dangerous dog under their declarations. HOA cites some declaration from the CCR's however, the filed declarations do not include this dangerous dog  that they are relying upon. The HOA also wants to make entry into clients home for the purpose of inspection via landlord notice.

Also, there are other owners within in the HOA who have Rottweiler's.

How are others handling this situations? Is there some type of discrimination issue here. Thank you.
