Mates,
I would like to know if anyone has encountered the following scenario with
DSHS. Client purchased a home and needed parents to cosign the loan.
Client made down payment, paid all closing costs and paid all mortgage
payments. At the time of closing the warranty deed listed parents and
client on title as grantees. Neither parent ever lived in the house, they
simply were the accommodation party to get the loan. When the house was
paid off the DOT was reconveyed but no one removed the parents names from
title by deed. Many years later both parents are deceased. Mother received
care benefits and DSHS has a large six figure lien. I don’t believe
parents had an interest in the property to which the lien can attach. I
can’t imagine this has not come up with DSHS in the past. Has anyone gone
through this? Thanks.-Brian
