[WSBAPT] Credtor claim by PR

The lawyer who filed the claim should note the hearing.  The procedure being followed is correct though—separate lawyer, and PR’s claim subject to court approval.


RCW 11.40.140
Claim of personal representative—Presentation and petition—Filing.
If the personal representative has a claim against the decedent, the personal representative must present the claim in the manner provided in RCW 11.40.070<https://apps.leg.wa.gov/rcw/default.aspx?cite=11.40.070>, and the allowance or rejection of the claim shall be addressed, resolved, and settled under the procedures provided under chapter 11.96A<https://apps.leg.wa.gov/rcw/default.aspx?cite=11.96A> RCW. This section applies whether or not the personal representative is acting under nonintervention powers.

Hello,

I am representing a PR who also filed a creditor's claim (through another attorney).  I have been asked to note the matter for a hearing.  I see that the procedures to be used are the TEDRA 11.96A procedures.  This seems like overkill to me and I'm wondering if perhaps anyone out there can tell me I'm reading the statute wrong.

Has anyone done this before?  I represent the PR and don't mind helping her to get this calendared but I don't want to advocate one way or the other because of the conflict (family already fighting).

Any directions is greatly appreciated.
