Claim is not deemed “presented” until the later of (a) filing and (b) presentation to the PR. RCW 11.40.070. So the time for rejection of a claim of less than $1,000 under RCW 11.40.090 won’t begin to run until a PR is actually appointed and qualified, and is served with the claim.

Hello all:

I have a probate that has not yet been opened due to complications but has been filed.

A creditor has already filed a claim for less than $1000.00. Does the person petitioning for PR even have authority to allow or reject the claim? I know if no rejection is given for two months it is deemed accepted. Does this apply even if probate is not opened?
