This seems to come up quite a bit, and I have one that is brewing with the same facts; separate property house, CPA, and in fact a Will leaving everything to surviving spouse.  One thing I may try, is after recording the CPA, ask a title company to insure house in surviving spouses name.  I might get the same push back, ie, wanting letters, but its worth a try.

Thanks Laura. The branch manager merely referred us to the mortgage team, and I can’t seem to wind my way through the phone tree to find someone at the manager level. 

 

So… off to write a letter to legal!

Hi Anna,

I haven't dealt with this issue specifically, but where financial institutions are not following the law, I will try first with the branch manager. If that doesn't work, send a letter certified mail to the branch manager with a copy to the legal department. Let BECU's lawyers straighten out their own employees. This has worked well. in the past.

I’m having trouble with BECU accepting a successor in interest for a mortgage. The beneficiary is the surviving spouse. Deceased spouse owned the house as separate property, but they had a community property agreement. The CPA, death certificate, and supporting affidavit have all been recorded. BECU is requiring either Letters, a new deed, or some other court order transferring the property to the surviving spouse. Has anyone had success persuading BECU that none of that is required under WA law for the house to transfer under the CPA?
