Good morning,

If someone does a Will Only filing - can you file anything in the same cause number?

Sister states that her brother had a crazy girlfriend about two years ago when he became ill, and he made a will that left everything to her.

Girlfriend left him about a year ago, and brother named sister as his Power of Attorney.

Sister helped him sign a Revocation of Will she found on the internet. Had it notarized. Notary and brother-in-law can attest to his signing this document at the bank.

He did not prepare a new Will.

Sister, as Agent, helped him do a Transfer on Death Deed for his house to their mom. They sold his cars to get money for his care.

Brother died two weeks ago.

Girlfriend materialized after having been gone for a year or so, and filed a copy of the Will as a Will-Only filing.

With the house in Mom’s name now, there aren’t any assets of value left in his estate.

Can/should the sister file the Revocation of Will in the Will Only cause number?

Thanks for any input you might have!

Amy
