[WSBAPT] Dueling Probates

I have had this happen a few times.  Once Letters are issued, the PR / Administrator is officially serving in that capacity.  In one case, I filed, I gave proper notice and set for hearing.  Behind my back, another attorney filed in a small county and did so ex parte, gave  no notice pursuant to statute and the Court signed their Order and Letters were issued.  This other attorney knew we had filed and set hearing on the matter.

We objected to the Order and Letters, and it fell on deaf ears.  So, our case was dismissed.

Does anybody know any case law on this?

If two parties file a Petition for appointment of an administrator in two different counties, which prevails? Is it the one that FILES first? Or the one where the ORDER IS ENTERED first?
