Jeff,
I cannot recall the specific case but i have done it. Just draft a PSA
between estate and heir for the agreed upon purchase amount. Insert lang
acknowledging that purchase price is reduced and that upon completion will
be deemed to receive his/her share in full.
Remember excise tax and closing costs need to be addressed between estate
and purchasing heir.

Listmates:
Mom passed. Her two children will share equally. One wants to purchase the
other's interest in mom's home by paying $X to the other heir. How best to
structure this? Is P & S done with the estate with the proceeds going
directly to the other heir and the PR deed going to the buying heir? Does
anyone have a contract, they can share, that does this?
