The trust is valid before being funded. But as for funding with real property, nothing will substitute for a recorded (valid, correct, accurate) deed. If it is not transferred in before death, the pour-over will must be probated and the property transferred by the PR.

However, wherever s/he is going, if s/he has (or can "get to") an iPad or laptop or computer with ordinary FaceTime/Zoom/Teams/Meet type video call capability, s/he should be able to remotely online notarize these deeds quite easily in a matter of minutes. The deeds can be e-recorded with REETAs. Voila! S/he could be standing on a mountain in Africa if s/he had a reliable data connection. The RON should use a legit/recognized RON service -- I'm a HUGE fan of Proof.com at this point after lots of absurdities with others; and there shouldn't be a problem in any Washington county.

Hi, Listmates.

I'm working on an estate plan which involves creating a revocable living trust that converts to an irrevocable trust at death, with the irrevocable to provide for support and maintenance of an adult child. Some of the trust property is real property. Trustor unexpectedly might be traveling for a bit, and not be in a position to get some Quit Claims notarized for a few months (uncertain how long possible trip might be). How soon after making the RLT does the administrative transfer of the real property to the trust have to take place? Is a declaration of intent to transfer property into the trust sufficient to make the trust effective, even if (worst-case scenario) the Trustor died in a plane crash before they could do the actual transfer?
