Hello Listmates,
A PC's wife passed away recently and to PC's surprise had failed to designate him successor custodian for several of their minor grandchildren's financial accounts. PC's wants to either move the accounts to another financial institution or consolidate with other accounts. However, the financial institution refuses to release the funds saying he has to file a petition pursuant to the Uniform Trust to Minors Act, designating him a successor custodian of the accounts before they will allow him access to the funds.
I've not dealt with the Uniform Trust to Minors Act, however I was able to find what appears to be a very general template at RCW 11. 114.180(4). Unfortunately, I didn't find that very helpful. Also, I looked at our county court case information cover sheet to determine what category this UTMA petition would fall under when I filed the petition but couldn't determine where it would fit.
Any suggestions and/or guidance is very much appreciated.
If you have any questions please do not hesitate to contact me.
Regards,Mario Ledesma
