In all of my estate sales I have requested that the purchase and sale agreement specifically state that the parties wave the disclosure statement except for the hazardous materials provision and I have never had any kick back from the buyer or the buyers representative even where the buyer has been represented by counsel since it is always a contingency that they have an inspection

Subject: [WSBAPT] Form 17 disclosures

Greetings List Members -

One of my executors has signed for the sale of property of which he is the executor fo both the mom and dad's estate.

My question - on the form 17, there are four options - yes, no, I don't know, and N/A

Which is the appropriate answer? I feel that if he checks the I Don't Know box that it could somehow transcend into a discussion of what he actually knew as a person, and not just the role of Executor. As where if he checks N/A - that would be feel more appropriate.

Anyone have specific insights?
