[WSBAPT] Need referral for trustee for Deed of Trust

Is sub (3) stating a restriction or specifying the trustee’s duties? Even if the former (as I would choose to read it so as not to land in lawyer jail), a beneficiary who lends money has no interest in the subject real property, unless they do for reasons external to the transaction being secured by the DOT.

Dear Candace:



My firm has served as the Trustee on Deeds of Trust in the past, even in circumstances where I have represented the Beneficiary.  If the qualifications listed in RCW 61.24.010(1) are met, the only prohibition on serving as the Trustee could be under RCW 61.24.010(3).



If you still need someone to serve as Trustee under a Deed of Trust, I can serve in that role.

Hi all,



I need to draft a WA Deed of Trust for a private loan agreement, and am having difficulty finding a RCW 61.24.010  trustee to list.  Listing myself as the trustee would be a conflict of interest because I represent the beneficiary.



Does anyone have a suggestion, including self-referrals?  It is entirely possible that the debtor will default on this loan; all is based in King County.
