I am not precisely sure which legal issues you are talking about....if you
are thinking a claim against the hospital for the handling of the case, I
will say that I have had similar issues like this and none of my PI
colleagues will touch this with a 100 foot pole given their age, the
"damages" and how those are caused by the error they made. If she is still
in the rehab center, she should still be able to qualify under Medicare for
up to more than three months in the rehab.
I have frequently lobbied our legislators about how no one cares about the
aged, aging, dead, or dying - but without liquidated damages codified in
statutes that also provide for attorneys fees, this portion of our
population (which we will all hopefully live to see) have hardly any
advocates in civil cases once you have passed the age of wage earning. (I
am oversimplifying as to not take the entire soap box off the shelf).
