[WSBAPT] Successor Trustee - Non-judicial Foreclosure

In my experience the beneficiary appoints the law firm or the attorney that is doing the non judicial foreclosure as the successor trustee I've been doing that For 40 plus years I've never had a problem since the trustee under a deed of trust can be a law firm or an attorney and the beneficiary has the right to a point whoever they want as long as they're eligible under the statute to be the successor trustee.

Subject: [WSBAPT] Successor Trustee - Non-judicial Foreclosure

We represent the Personal Representative of an Estate.  The Decedent seller-financed the sale of a commercial property and the Estate holds the promissory note.  The borrow did not make regular payments while the Decedent was alive and has not made any payments since the beginning of the year.  The borrower has been sent a demand letter but has not responded in any way.

The Estate wishes to do a non-judicial foreclosure under the Deed of Trust, but Stewart Title, the named Trustee, no longer does non-judicial foreclosures.  The referral they provided also no longer does.

Does anyone have any referrals or suggestions for Title Companies who would be willing to serve as the Successor Trustee on a non-judicial foreclosure?
