Michael -
What you described sounds reasonable - however, depending on the factors
(size of estate, county, etc.) I might consider seeking a motion to
transfer property by Court order.
I have never done it for this specific situation, but it is what I use when
it is discovered that Spouse 1 died and the surviving spouse did nothing
and so now we have a probate for Spouse 2 (after their death, obviously)
and the PR discovers that Spouse 1 is still listed. I have a simple
petition where I lay out the facts to the Court, and fall on the sword of
efficiency and justice and ask for a Court order that states that Black
Acre Farm is hereby permitted to be transferred directly into Wife's RLT.
As I am writing this, I am not taking into consideration any other issue
that may be presented by doing this - but simply the most efficient way to
get Black Acre into the RLT.
