When I was in law school, I was taught that a person could use any name they like, without legally changing their name, as long as it was not done to defraud someone. I have never heard anyone tell me anything different.
My mother spent her entire life referring to herself as Dee, even though her birth certificate said Dessie.
I have a client who spent his entire professional life using one name, even though his legal name was very different.
I don’t have any legal authority to cite on this subject. So this is merely my opinion.
I think you can go ahead and notarize, but you might feel more comfortable referring to the notarized person as “formerly known as”.

Client/friend got divorced last year, and is now changing her name. Court date for the name change isn't until August.
Her estate planning documents will be in her new name. Can we sign them now, even though her ID still has her current name?
