Amy, my first thought is you should petition for a guardianship or conservatorship for this gentleman as an heir to the Estate who is incapacitated.  Not sure if your client is serving as PR/Admin, but if an heir is incapacitated or a minor, they need a probate GAL.

Before the new GAL rules this year, I had an estate that had an heir who, like the one in the house, was obviously not able to make any decisions and was not taking care of himself physically or financially.
He became very belligerent to me and his two siblings (all heirs).  I petitioned the court for a guardian to be appointed and it was granted.  I was serving as the PR of the Estate and eventually, we were able to have the man move because he needed nursing care.  Then, the Estate could proceed.

Good Afternoon!

I have an ongoing probate matter in Pierce County where the primary beneficiary is living in the decedent’s house. He is an older man who was the boyfriend of the decedent, and may be showing signs of dementia.

There was very little money or assets in the estate other than the house. There is a DSHS lien, property taxes owed, creditor claims and costs of administration.

While he was initially cooperating, we listed the house for sale and got an excellent offer and a back up offer. Unfortunately, the beneficiary then sent a certified letter indicating there was NO WAY he would ever leave the house. Both the offer and the back up offer were rescinded.

We tried to connect him with a reverse mortgage broker but he wouldn’t proceed with the process.

Now he is getting more confused and we have become concerned about his well-being. He seems to think it is his house and we should just leave him alone.

Any suggestions at this point? The only thing I can think of at this point is to evict him and sell the house.

He will receive a good chunk of money if we could get this done.

Does someone know an eviction attorney in Pierce County that we could hire or that we could speak to about options?
