Okay, this sounds highly unusual to me, but I would like some other thoughts from people who know more than me.

Issue: Trustee client wants me, as their attorney, to write a letter on behalf of a beneficiary to a foreign bank. The letter would say that 50% of all assets in the trust account belong to the beneficiary. (One problem is that the assets include a house and it has not yet been sold, so I don’t have an exact dollar amount in the account.) The reason would be to avoid any temporary holds on transfers of more than $10,000.

I don’t see that my representation of a trustee includes writing letters to foreign banks for the beneficiary to make things easier for them. I could see a receipt with a note that the funds are a partial/full distribution of the beneficiary’s share of the trust. The beneficiary could show his foreign banker that receipt.

Any thoughts?

Thank you.
