I have had this scenario various times in the past, and in each case the beneficiary of the property takes it works at all the same as if the property had a mortgage on it, which will then becomes the responsibility of the beneficiary I believe is it important when drafting the will That if different properties are left to different heirs, there should be a recitation as to responsibility of any repairs or maintenance of the property is subject to the bequest whether it be the estate or the beneficiary of the bequest.

Father dies sleaving two children .Each gets a house and 50/50 of remainder. One house has hazardous materials. County has filed a complaint to abate the nuisance and a mandatory injunction of the nuisance on the property. Who pays for the abatement and cleanup? The estate or do we transfer the property it to the son and he pays for cleanup.
