[WSBAPT] Transfer to Irrevocable Trust

Dear All,
Need your help on this situation:
Early February 2023, A signed papers to transfer investment products ($$) to the Irrevocable Trust A created. The purpose was to use the Federal Lifetime Exemption. The investment firm (a Big Bank) confirmed the transfer would become effective 3/31/2023.
A passed away before 3/31/2023. The Big Bank is discussing the options, for example,
(1) the Big Bank may treat the transfer effective when A signed; then this is a time-life gift of A (A desired so as WA estate tax is reduced);
(2) the big Bank may cancel the transaction (as if A never signed the papers), the investment products become A's estate pass to designated Beneficiary;
(3) the big Bank may allow the transfer to become effective 3/31. I have questions about this approach: the investment products are A's estate (since not lifetime gift), pass to Beneficiary per TOD, so it is Beneficiary who transfers her own $$ to the trust (Beneficiary is also the sole primary beneficiary of the trust). A's trust document allows third party funding, but do you see any issues if Beneficiary transfers her own money to the trust created by A for the benefit of Beneficiary?

Decedent heavily marked up her original living trust taking out and adding
beneficiaries. You can read through the markups. We have a clean copy of
the trust. I do not know if this is treated differently then a marked up
Will, which if you can read through the markups, the Court enforces the
original language. Trusts are contracts. Do the markups change that, or
does it invalidate it? I am inclined to send both documents to the named
people.
Have any of you dealt with this before?

As I understand the facts, I would say that title passes to the sole heir by the laws of intestacy. The Lack of Probate Affidavit merely puts evidence of such passage of title in the public record.

Jeff,
Until the property transfers or the client tries to borrow against it, no one will be reviewing this to confirm child as sole owner. If I recommended the client to anything now, I would generally err on the side of doing a probate, or getting title insurance now. If those seem like too much trouble or cost, I'd likely do nothing and wait until the next insurable transaction, letting the child know that they will need to take steps to satisfy the title company at that time.

Yes, trusts are contracts, sort of. But a revocable living trust is entered into between the trustor and the trustee. They usually the same person. What does the trust say about the formalities that are needed for an amendment?

Decedent heavily marked up her original living trust taking out and adding beneficiaries. You can read through the markups. We have a clean copy of the trust. I do not know if this is treated differently then a marked up Will, which if you can read through the markups, the Court enforces the original language. Trusts are contracts. Do the markups change that, or does it invalidate it? I am inclined to send both documents to the named people.

This exact question comes up all the time. If you ask six different appraisers, you will get six different answers. Most appraisers would estimate the useful life of the copyright, and then use a capitalization rate to determine the current fair market value. Estimating the useful life, and determining the capitalization rate, is both a science and an art. There is no one answer.

The trust states any modification "shall be valid and fully effective
whenever Trustee shall receive from Trustor written notice thereof, . . . "
An argument can be made that the hand written markings, on the original
trust, are notice to the trustee. In looking at RCW 11.98.008, .009, 011,
you don't have the same requirements for creating a trust as you do Wills.
In fact .014 allows for oral trusts. I do not see anything in RCW
11.103.030, that would invalidate the markups.
So, the argument can be made the hand written revisions by the Trustor
during her life time are valid. It just doesn't seem right without a formal
amendment.

Yes, trusts are contracts, sort of. But a revocable living trust is entered
into between the trustor and the trustee. They usually the same person. What
does the trust say about the formalities that are needed for an amendment?

Decedent heavily marked up her original living trust taking out and adding
beneficiaries. You can read through the markups. We have a clean copy of
the trust. I do not know if this is treated differently then a marked up
Will, which if you can read through the markups, the Court enforces the
original language. Trusts are contracts. Do the markups change that, or
does it invalidate it? I am inclined to send both documents to the named
people.
Have any of you dealt with this before?

I am looking for life estate resources. Anyone have a good primer or updated briefing on life estates?
I found nothing in WA Law of Wills, Estate Planning or Probate WA Probate Deskbooks.
My client (A) was provided a life estate in the mother's home after death along with his brother (C) in his mother's Will. The home is owned 50% by another brother (B).
They are not on the same page at all. A lives in the home, C moved recently and B is threating partition for sale. A does not want to move and wants to honor his mother's wishes for him to be able to live there until he dies.

I am looking for life estate resources. Anyone have a good primer or
updated briefing on life estates?
I found nothing in WA Law of Wills, Estate Planning or Probate WA Probate
Deskbooks.
My client (A) was provided a life estate in the mother?s home after death
along with his brother (C) in his mother?s Will. The home is owned 50% by
another brother (B).
They are not on the same page at all. A lives in the home, C moved
recently and B is threating partition for sale. A does not want to move
and wants to honor his mother?s wishes for him to be able to live there
until he dies.

I would agree with Tom. I would think (without doing any legal research whatsoever) that the life estate would be an unreasonable restraint on alienation for the other property owner.

I found nothing in WA Law of Wills, Estate Planning or Probate WA Probate Deskbooks.
My client (A) was provided a life estate in the mother?s home after death along with his brother (C) in his mother?s Will. The home is owned 50% by another brother (B).
They are not on the same page at all. A lives in the home, C moved recently and B is threating partition for sale. A does not want to move and wants to honor his mother?s wishes for him to be able to live there until he dies.

Agree with Tom and Phil. I have litigated this and there ain't no bright-line authority; it's an equity free-for-all over ownership percentages, burden of property tax and insurance and repairs costs, what's a repair versus an improvement, etc. The WSBA Real Property Deskbook is the best starting resource I have found for further research.
The whole issue of partition, already difficult with fee owners, is drastically complicated by the life estate-the exact parameters of the life estate and its value is difficult to ascertain except on highly assumption-biased "evidence" such as actuarial life expectancy, future rent replacement value net of future projected expenses, and reduction to present value. Then balancing that hypothetical value against the remainder interests of the fee owners and finding an equitable division of sale proceeds among them all....See RCW 7.52.300 et seq., which are lovely rhetoric from Washington's territorial days but aren't much guidance. The full implications of RCW 7.52.320 I can't imagine, since it implies that the life estate holder's share is deposited with the court for purposes of investment and not given to them outright.
I also wouldn't assume that the interest is actually a "life estate" in the classical freehold estate sense, because in my experience it almost always isn't. Unless there's a deed that expressly conveys a "life estate" without other conditions there are almost always limiting factors that make it something less than a true life estate, which also decrease its value on partition.
