That is why we typically go ahead and probate if the surviving spouse has no intentions of selling in the near future.  Probate is the only way I’m aware of to provide the surviving spouse (and his or her future beneficiaries) with certainty that there won’t be an issue many years in the future.

In my experience, not until a transfer and you provide it……other’s may do much more real estate than me though and have better insight.

House is name of husband and wife. Bought while married, so community property. Husband dies, there is no community property agreement, so is probate necessary to put title in wife's name?
