[WSBAPT] DSHS lien

Hi Dalynne,

A lien or a payment request or a creditor's claim?  Has there been a death (or two)?  The period of services covered can expand from the point of service I believe.

There is great debate around when they can file a lien on listserve but I just spoke to someone, literally yesterday at lunch, who indicated that if there is a surviving spouse, no lien can be filed - further more, if said surviving spouse sold, no recovery to DSHS, this was interesting to me and I plan to visit more with him on this.  Regarding creditor's claim and probate, he opinioned that there was not Federal State conflict and that the creditor process governed and if notice was given after death that DSHS was bound by our RCW.  Again, there has been debate on this but I can tell you, I somewhat recently rejected a "claim" for being untimely and was told I would be turned over to the AG - I responded that I was happy to consider working with the AG.  This also happened to another listserve member back in June I believe - same threat - no follow up.

I received a DSHS lien with charges from 1/14/2009 to 8/1/2021.
Is there no statute of limitations on making claims from DSHS or do they make their own rules with charges over 13 years ago?
