The excise tax affidavit is, in my opinion, not required.  It’s only purpose is to avoid liability for excise tax on the “conveyance” from the deceased spouse to the surviving spouse.  I don’t see anyone at the county or at the department of revenue raising an issue about excise tax liability on this one.

Colleagues,

I need to clear a decedent’s name off title to real property in favor of his surviving spouse.  There is a community property agreement, which was recorded in 1975.  I was under the impression that I only needed to record the certified copy of the death certificate and a REETA to transfer the property into the wife’s name….  But when I go to record the DC via Simplifile, there’s no place for uploading a REETA.  It feels incomplete to record the DC and reference the abbreviated legal and TPN on the cover sheet without a separate document explaining the transfer and the WAC citation for the exemption.  HELP!  What am I doing wrong?
